USITC opens Section 337 probe into Roku, Hisense display and streaming imports over patent complaint

The U.S. International Trade Commission has initiated a Section 337 investigation following a petition from InnoTV Labs LLC that accuses Roku, Hisense and related importers of infringing patents through certain display devices, streaming players and components. The petitioner seeks a limited exclusion order and cease-and-desist orders to block the contested imports.

Key Points

  • USITC has initiated a Section 337 investigation into certain Roku and Hisense branded display devices, streaming players and components.
  • InnoTV Labs LLC of Las Vegas is the petitioner and alleges its patents were infringed by imports from Roku Inc, Purple Tag Media Technology Shanghai Ltd, Hisense Visual Technology Co and related companies.
  • The petitioner has requested a limited exclusion order and cease-and-desist orders to prevent the contested imports from entering the U.S.

WASHINGTON, April 1 - The U.S. International Trade Commission announced on Wednesday that it has launched a formal Section 337 investigation into alleged patent violations involving certain display devices, streaming players and related components marketed under Roku and Hisense brands.

The petition that prompted the probe was filed by InnoTV Labs LLC, a company based in Las Vegas. In its filing, InnoTV Labs contends that patents it owns were infringed by devices and components imported by several entities, including Roku Inc, which is based in San Jose, California; Purple Tag Media Technology Shanghai Ltd; and Hisense Visual Technology Co, which is based in Qingdao, China, along with related companies.

InnoTV Labs has requested that the USITC issue remedial relief in the form of a limited exclusion order, which would bar entry of the allegedly infringing imports into the United States, and cease-and-desist orders directed at the importers and related parties. The commission confirmed it has opened the Section 337 investigation to examine those claims and the requested remedies.

The administrative notice from the USITC identifies the subject matter of the probe as certain Roku and Hisense brand display devices, streaming players and components. The investigation will determine whether the imported products infringe the patents asserted by the petitioner and whether the requested exclusion and cease-and-desist orders are warranted under Section 337 law and commission precedent.

The USITC proceeding represents the formal start of an administrative review of the infringement allegations and the remedies sought by the petitioner. The commission will follow its established procedures to investigate the claims, including any evidence provided by the parties and any responses from the named importers and respondents.
